Payments
All services are secured by a major credit card but not charged until completion of service. Payment methods include cash, check, money order, and Visa/MasterCard made payable to R. Nick Vetter, P.A. Services scheduled with less than 24 hours notice are scheduled with a convenience fee of $25.00 in addition to hourly fees to accommodate necessary schedule changes. Any prices listed by Bonita Valet Services are for services rendered by R. Nick Vetter, P.A. and do not include charges for third party vendors or merchandise purchased to complete the service request.
Contract Minimums
Your Bonita Valet insists on your complete satisfaction. Minimum term contracts are NOT required for any service provided by Bonita Valet Services. If you are unhappy with your service for any reason, you may discontinue at any time with no further charges incurred.
Errands
All errand rates include time from the beginning of the task through completion and for the first 15 miles of travel. Travel over 15 miles will be billed at the rate of $0.38 per mile.
Pets
Services requiring the care or transportation of pets require that the client provide a suitable pet carrier and proof of vaccinations.
Cancellations
If it is necessary to cancel a scheduled service, Bonita Valet Services requires 24 hours notice. Failure to provide any notice will result in the full price of service being charged. Cancellations within less than 24 hours of scheduled service will be assessed a $25.00 fee.
Access to Client’s Property
If Bonita Valet Services can not gain access to the client’s residence or place of business, the client will be charged the full cost of the service. For home watch services, the owner will provide necessary keys, gate access codes, subdivision entry passes, and alarm codes in order to complete the scheduled services.
Special Scheduling
Services rendered outside of regular business hours may be arranged but will be assessed a $25.00 convenience fee per day in addition to hourly fees.
Privacy Policy
All personal and credit card information collected by Bonita Valet Services will be gathered for the purpose of providing concierge services and billing the client for services rendered. At no time will the collected information be disclosed to a third party, except for the purpose of completing the client’s financial obligation to Bonita Valet Services.
Limitation on Liability
Except in jurisdictions where such provisions are restricted, in no event will Bonita Valet Home Watch and Concierge Services be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits, even if Bonita Valet Home Watch and Concierge Services has been advised of the possibility of such damages. Bonita Valet Home Watch and Concierge Services maintains the right to refuse any business or service or request it feels is unsafe, unsuitable, and illegal for its employees.
Warranties and Limitations of Liability
Bonita Valet Home Watch and Concierge Services does not provide any warranties unless stated otherwise on the website and service agreements. Bonita Valet Home Watch and Concierge Services warrants to the Client that Bonita Valet Home Watch and Concierge Services shall endeavor to use reasonable care and skill in providing all services and, as far as reasonably possible, in accordance with the Client’s requests and instructions. Where Bonita Valet Home Watch and Concierge Services provides the Client with any goods or services supplied by a third party, Bonita Valet Home Watch and Concierge Services does not give any warranty, guarantee, or provide representation as to the quality, merchantability, or fitness for a particular use or otherwise of the goods or services, and the Client shall be required to seek compensation for any loss or damage suffered from such third party direct. As a convenience to the Client, Bonita Valet Home Watch and Concierge Services may provide suggestions or recommendations for a third party in relation to services and the Client is deemed to be responsible for, and shall use its own skill and judgment as to the quality, value and suitability of any such information and suggestions in deciding whether to enter into any contract with any third party for the supply of services or sale of goods. Bonita Valet Home Watch and Concierge Services shall not be liable or be deemed to be in breach of contract by reason of any delay in performing, or any failure, any of Bonita Valet Home Watch and Concierge Service’s obligations in relation to the services, if the delay or failure was due to any cause beyond Bonita Valet Home Watch and Concierge Service’s reasonable control. Subject to the provisions of this clause, Bonita Valet Home Watch and Concierge Service's maximum liability to the Client for breach of any of its obligations hereunder shall be limited to the value of the Charge (provided that the Charge has at such time been paid by the Client in full). In no event shall the total aggregate liability for Bonita Valet Home Watch and Concierge Services exceed the amounts paid by Client for the products or services.
Dispute Resolution
If a dispute should arise, then the dispute will be governed by the laws of the State of Florida without regard to its conflict of law provisions and you consent to personal jurisdiction, and agree to bring all actions, exclusively in state and federal courts located in Lee County in the state of Florida. You agree to waive any right you may have to commence or participate in any class action against us related to any claim and, where applicable, you also agree to opt out of any class proceedings against us. Notwithstanding the foregoing, we reserve the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the courts.
